JOBSDHAMAKA SITE SECURITY RULES

The Company will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

REGISTRATION & PASSWORD

You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify the Company of any unauthorized use of your registration or password.

DISPLAY OF RESUME

The payment for service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated.

The amount paid entitles the subscriber alone to the service by JobsDhamaka.com for a period of subscription opted for from the date of up-linking of the resume on the website JobsDhamaka.com or such other mirror or parallel site(s) as JobsDhamaka.com may deem fit and proper but such web host shall be without any extra cost to the subscriber / user.

JobsDhamaka.com offers no guarantee or warranties that there would be a satisfactory response or any response at all once the resume is put on display.

JobsDhamaka.com neither guarantees nor offers any warranty about the credentials of the prospective employer/organization which down loads the information and uses it to contact the prospective employee / visitor / user / subscriber.

JobsDhamaka.com would not be held liable for loss of any data technical or otherwise, and particulars supplied by subscribers due to reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond JobsDhamaka.com's reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.

It shall be the sole prerogative and responsibility of the individual to check the authenticity of all or any response received pursuant to the resume being displayed by JobsDhamaka.com for going out of station or in station for any job / interview and JobsDhamaka.com assumes no responsibility in respect thereof.

The Courts at Delhi alone shall have the sole and exclusive jurisdiction in case of any dispute.

JobsDhamaka.com reserves its right to reject any insertion or information/data provided by the subscriber without assigning any reason either before uploading or after uploading the vacancy details, but in such an eventuality, any amount so paid for, shall be refunded to the subscriber on a pro-rata basis at the sole discretion of JobsDhamaka.com.

JobsDhamaka.com will commence providing services only upon receipt of amount/charges upfront either from subscriber or from a third party on behalf of the subscriber.

This subscription is not transferable i.e. it is for the same person throughout the period of subscription.

JobsDhamaka.com has the right to make all such modifications/editing of resume in order to fit the resume in its database.

The liability, if any, of JobsDhamaka.com is limited to the extent of the amount paid by the subscriber.

The subscriber shall be assigned password (s) by JobsDhamaka.com to enable the subscriber to access all the information received through its site JobsDhamaka.com, but the sole responsibility of the safe custody of the password shall be that of the subscriber and JobsDhamaka.com shall not be responsible for data loss/theft or data/corruption or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. JobsDhamaka.com undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.

The subscriber undertakes that the data/information provided by him is true and correct in all respects.

ROLE OF JOBSDHAMAKA.COM

JobsDhamaka.com is only an online venue. This portal acts as a venue for employers /consultant to post job opportunities and candidates to post resumes and does not screen or censor the listings offered. The Company is not involved in the actual transaction between employers and candidates. As a result, the Company has no control over the quality, safety or legality of the jobs or resumes posted the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site and/or the other JobsDhamaka Sites.

Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each user is who they claim to be.

Because we do not and cannot be involved in user-to-user dealings or control the behaviour of participants on any JobsDhamaka Site.

We are under no legal obligation to, and generally do not, control the information provided by other users, which is made available through the Web Site and/or the other JobsDhamaka Sites. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabelled or deceivingly labelled. We expect that you will use caution and common sense when using this Web Site and/or the other JobsDhamaka Sites.

The Web Site Content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of any JobsDhamaka Site or the Web Site Content. The use of JobsDhamaka Sites and the Web Site Content is at your own risk. Changes are periodically made to JobsDhamaka Sites and may be made at any time. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume or material contained therein placed by you on the JobsDhamaka Sites. Employers are solely responsible for their postings on JobsDhamaka Sites. The Company is not to be considered to be an employer with respect to your use of any JobsDhamaka Site and the Company shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on any JobsDhamaka Site.

POLICIES & PRICING

Employers as well as Resume Owners that Register at our site, shall be deemed to be customers of JobsDhamaka.com. Accordingly, all of our Terms of Use, rules, policies, and operating procedures concerning customers, our services, and our pricing shall apply to those customers. We may change our policies and operating procedures at any time and without any notice to customers. For example, we, in our sole discretion, shall determine the prices to be charged for Resume downloads in accordance with our own pricing policies.

BUYING PURPOSE & RULES

"A Justified Purchase" means a complete, successful, confirmed and valid purchase of contact information by an Employer or a User paying to access the Site. Any purchase that is withdrawn, disputed or otherwise voided by the payee or any other party cannot be considered an "A Justified Purchase". Final determination of whether each purchase is considered an "A Justified Purchase" is at sole discretion of JobsDhamaka.

There can only be one "Justifying Download" of Contact Information for each Resume downloaded by each Employer. In other words, the same Employer repeatedly downloading the contact information of the same Resume will NOT result in additional Justifying Downloads. However, the same Resume can be downloaded by multiple Employers, with each Employer's download resulting in a separate Justifying Download. Final determination of whether each Resume download is considered a "Justifying Download" is at sole discretion of JobsDhamaka.

"Justified Buying" means a commission payable to Customers when their contact information from their resume is viewed. Justifying Buying can be of several types and amounts. "Justifying Referral" means another User (with a complete, successful and confirmed Registration) that was invited by a Customer by e-mailing or providing them with an Invitation Code or by referring them through an Affiliate Link. Any Registrations that are not successful, that are incomplete or invalid, or any Invitations or Referrals that are not properly documented, recorded and assigned by JobsDhamaka.com, can not result in Justifying Referrals. Final determination of whether each Registration is considered a "Justifying Referral" is at sole discretion of JobsDhamaka.

All Payments are calculated as sums of Affiliate's Justifying Buying resulting from Justifying Downloads of Contact Information.

DISCLAIMER OF WARRANTIES & LIMITATION OF LIABLITY

This site is provided by "scuba corporate services pvt limited" on an "as is" and "as available" basis. Jobsdhamaka.com makes no representations or warranties of any kind express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, jobsdhamaka.com disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Jobsdhamaka.com does not warrant that this site, its servers, or e-mail sent from jobsdhamaka.com are free of viruses or other harmful components. Jobsdhamaka.com will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

As to extraneous contents: JobsDhamaka.com hereby alerts and warns its members of the possibility of unauthorized posting of contents by any person including members and unauthorized users and advises discretion in access since such content, information or representation may not be suitable to you including being offensive. JobsDhamaka.com will not in any way be responsible for such content, information or representations. JobsDhamaka.com is also not responsible for alterations, modifications, deletion, reproduction, sale, transmission or any such misuse of data and content in the public domain by any user.

REFUND OF FEE

If you choose to terminate your membership, the MEMBERSHIP FEES ARE NOT REFUNDABLE However If offered services will not be delivered within 30 days after receiving payment, then you can cancel the order, jobsdhamaka.com will refund your amount within next 30 days.

Your membership in the JobsDhamaka.com service is for your sole, personal use. You may not authorize others to use your membership and you may not assign or transfer your account to any other person or entity.

SITE POLICIES, MODIFICATION & SERVERABILITY

Please review our other policies, such as our pricing policy, posted on this site. These policies also govern your visit to www.JobsDhamaka.com and consortium of portals. We reserve the right to make changes to our site, policies, and these Terms and Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

APPLICABLE LAW

The membership is deemed to have been entered into at Delhi, India and the laws of India will govern the membership. Disputes arising out of or in any way affecting the membership including interpretation of any of the terms are to be referred to arbitration under the Arbitration and Conciliation Act 1996 [Indian Act] at Delhi before a sole Arbitrator to be appointed by the JobsDhamaka.com.
